What does an overseas worker need to do to work in the UK?

Under the UK government’s points-based immigration system, there are a number of requirements that an overseas worker must meet in order to be eligible to work in the UK.

Julie Moktadir, Partner at Stone King LLP

Stone King Partner Julie Moktadir, who heads the firm’s Immigration team, says: “Each requirement under the new points based-system is assigned a specific number of points. To be eligible to apply as a Skilled Worker an overseas applicant must obtain a total of 70 points.”

An overseas applicant must obtain 50 points from the mandatory requirements list, for example the mandatory requirements for Skilled Workers include:

-          Having a job offer from a licenced sponsor (20 points)
-          Meeting the minimum skill level required (20 points)
-          Demonstrating the required level of English language proficiency (10 points)

The applicant must then obtain a further 20 points under the tradeable points list. There are a variety of options on this list, and they are generally based on the applicant’s offered salary and educational qualifications.

Julie adds: “Applying from overseas can feel overwhelming, but the points-based system is at least quite clear on what the requirements are for working in the UK.”
